Meta and Google are facing a legal reckoning that goes far deeper than content moderation battles. In two separate cases this week, juries delivered verdicts that target the very architecture of social media platforms, not just the content they host.
The first verdict came against Meta in a New Mexico case, followed quickly by a second ruling against YouTube in what's known as the KGM trial. Both juries concluded that the platforms' design choices, particularly around algorithmic recommendations and engagement features, caused measurable harm. The distinction matters because it sidesteps the Section 230 protections that have shielded social media companies from liability for user-generated content since 1996.
Section 230 of the Communications Decency Act has been the tech industry's bulletproof vest for decades. It says platforms can't be held liable for what users post. But these new verdicts argue something different. They say when Meta designs Instagram to maximize time spent scrolling, or when YouTube builds recommendation algorithms that keep users watching video after video, that's not protected speech.
